Acceptance of these terms

This document outlines the terms and conditions on which we offer you access to our website and service. As a paying or non-paying user of our website and service you agree to act in compliance with these terms and conditions.

 

Changes to these terms

The terms and conditions outlined in this document may be modified at any given time and without notice. Changes will be put into place immediately upon being published to our website. It is the responsibility of the user to comply with these terms and conditions at all given times.

 

Acknowledgement 

The user acknowledges that we are not a legal representative to any user groups and therefore we are not permitted to advise in relation to child employment or negotiate and/or sign off on employment forms and invoices. 

 

Confidentiality 

As a user of our website and service you agree to not distribute any information between you, us and any other users. 

 

Breach

An immediate termination of your membership will occur if you fail to comply with the terms and conditions as outlined in this document. We have the right to pursue legal action to users and/or visitors of our website and service who fail to comply with the terms and conditions as outlined in this document.

 

Use of third parties

We may use third party providers and publish and/or disclose personally identifiable information in order to provide certain services to you in connection with your membership. These Third Party Services include but are not limited to Facebook, Twitter, Instagram, YouTube, Google, Wix, PayPal, and 123FormBuilder, for the sole purpose of the provision of our services to you.

 

Privacy of your information

Information supplied by users are submitted to and archived on third party services, which may be stored for perpetuity. As a user of our website and service, you give us permission to submit and archive the information you supply us to third parties, in connection to your membership. 

Restricted access

We are not held accountable in the event where the user has restricted access to the website or service due to a fault in Internet connection, device or any other related softwares, programs and services providing access to the website and our service. 

For TALENT (also sometimes referred to as members/parents and guardians/users)

 

Application

Users who would like to join our database are required to submit their child’s first and last name, Date of Birth, state of residence, and two to three photographs to the email listed on our website for consideration. We hold the right to decline an application. Successful applicants receive an email from us with an offer to purchase a position on our database for talent presentation to talent buyers. Successful applicants will fill in an online form and pay the talent fee via PayPal. Applicants must reside in Australia and be 16 years or younger. All applicants must have parental or guardian permission to join. 

 

Fee

A talent fee of $100 is charged at the time of registration. Talent fees are subject to change at any given time and without notice. Payments are accepted via PayPal.

 

Service

The talent will have an online portfolio created on our website and this portfolio is listed in our database for inclusion in our talent presentations to companies and creatives. In order to select talent, companies and creatives search our database or send us a brief and we submit all matching talent. Companies and creatives contact us to enquire about talent and we contact the talent with the offer. We also email talent if they are submitted for a matching brief. Talent may also view the job board accessed on the website to see what other opportunities we have been working on. Our membership term is for a period of twelve months. Occasionally we may hold registration days, photography sessions or workshops. 

 

Cancellation and Refunds 

Full or partial refunds are not permitted. If a member would like to cancel they must email us to inform us of their decision. We will then remove their data from our website and they will no longer be presented for castings. 

 

Renewal 

The talent will receive one renewal notice email and one expiry notice email with a form to renew if they choose.

 

Book out

If talent will be unavailable for a period of time they should inform us of the dates that they are unavailable for. 

 

Guarantee

It should be advised that due to the nature of this industry no work or casting opportunities can be guaranteed. 

 

Information to provide

Members are asked to provide their child’s first, middle and last name, date of birth, home address, parent/guardian first and last name, parent/guardian contact number, parent/guardian email address, school name, principal, address and phone number, clothing size, shoe size, eye colour, hair colour, ethnicity, height, weight, special skills, prior experience and credits, photographs and preferred privacy settings. 

 

Consent to share and publish your information 

The parent/guardian permits Ashlee Collova Talent Solutions (ACTS) to present their child’s details, supplied by the parent/guardian to us, to companies and creatives via the website database and in submissions to briefs, without prior notice. The parent/guardian permits Ashlee Collova Talent Solutions (ACTS) to submit personally identifiable information supplied by the parent/guardian to us, without prior notice, to companies and creatives in connection with our membership service.

 

Content publishing

You acknowledge that as a user of our website and service;

 

    •    Any information supplied by you to us may be read and used by Ashlee Collova Talent Solutions (ACTS) and third parties. 

 

    •    Any information supplied to us may be utilised by us and third parties, without notice and at any given time for perpetuity, for online and offline advertising purposes.

 

    •    You give us and third parties permission to reproduce, modify, edit, adapt, translate, publish, distribute, perform and/or display information supplied by you, in whole or part, worldwide for advertising purposes. 

 

    •    Any information supplied by you is displayed by us in your online profile and the website directories, and can be viewed by anyone with the link. 

 

    •    The minor’s main photo, first name, age and location is displayed on the main talent directory screen available to the public. 

 

 

Your Responsibilities

 

Information

The user is responsible for supplying accurate information in connection to your membership. Users should email updates to members@myacts.online

 

Safety and supervision

As the parent and/or legal guardian you are responsible for the supervision and safety of the minor in relation to paid and unpaid work duties sourced through our website and service. By this, you ensure that any access and use by the minor to our website, service and third parties is fully supervised and monitored by you as the parent and/or legal guardian.

 

Employment

It is the responsibility of the user to apply for and obtain the required child employment forms. Should the user be required to negotiate and/or sign a contract or request payment for employment sourced through our website and service, it is the full responsibility of the user or their representative. You acknowledge that payment types on jobs may include but are not limited to cash, cheque, vouchers, discounts and goods and services free of charge. You acknowledge that some jobs available through our website and service are unpaid. You acknowledge that we do not charge commission and that payments are arranged between the talent and talent buyer, unless specified. 

 

 

Code of conduct

You agree to act in a professional manner when working with talent buyers sourced through our website and service. You acknowledge that we are not held responsible for the talent buyer’s code of conduct in engagements sourced through our website and service.

 

Working with children check

In the event that the talent buyer does not hold an active Working with Children Check card, the member is required to sign a ‘Non Working with Children Check card’ form on the website, which authorises us to coordinate the job or casting with both parties. This form acknowledges that the legal guardian of the minor is aware that the talent buyer does not currently hold an active Working with Children Check card and is still proceeding with the job or casting at their own accord, which was sourced through our website and service.

 

Privacy  settings

Users have the option of setting their profile to public or private at any given time during their membership term. 

    •    Private - the member’s profile can only be viewed by other registered users consisting of talent members and talent buyers.

 

    •    Public - the member’s profile can be viewed by anyone with the link, with or without registration.

 

Content warning

You acknowledge that some casting notices, promotional materials and media, related to the work of our members may contain material that is inappropriate for minors.

 

Network groups

Talent participate in our network group at their own accord accessed online through our website and social media. Talent have the right to remove themselves from the networking groups at any given time and without notice. We are not held accountable for users code of conduct and information or media sharing in the associated networking groups. We have the right to remove a user from networking groups if their code of conduct is deemed inappropriate, including but not limited to swearing, bullying, harassing and/or sharing inappropriate content.

 

Events

Talent participate in our events at their own accord of which they can register online accessed through our website and service. Talent who arrange events with other users through our website and service do so at their own accord and therefore we do not have any formal involvement in these events nor are we held responsible. 

 

Account access

Members can gain access to the exclusive website and service by signing in using the Talent Login button on the website, and entering their allocated login details consisting of an email and password. Login details are supplied to members at the commencement of their membership. Login details should be kept confidential and should not be shared with non-users. It is a breach of your membership to distribute your login details with non-users.

Amendments 

You acknowledge that we are not held accountable for amendments made by talent buyers and advertisers to listings upon being published and/or released. We may make modifications to your profile at any given time and without notice in connection to your membership.

 

 

COMPANIES AND CREATIVES (Also sometimes referred to as clients/talent buyers/user) 

 

Service

Our service assists companies and creatives in sourcing child talent for work in the advertising and entertainment industries. Companies and creatives can use our online database to search for talent and submit an enquiry for talent. In addition to this companies and creatives can apply for a login to view private portfolios. Companies and creatives may send us a brief and we will submit a customised talent list of all matching talent.  Companies and creatives may submit a talent enquiry via database searches or brief submissions, and we liaise the offer with the talent. We also offer a sourcing service, and can search outside of our talent pool, if we do not have suitable talent listed on our database at the time. A fee is charged for this service if you select talent outside of our database through a search conducted by us.

 

Your responsibilities

 

Information

The user is responsible for providing accurate contact details and information in relation to their company and job description including but not limited to potential risky tasks required of talent.

 

Working with our talent

It is the responsibility of the talent buyer to provide the following when working with our talent;

    •    A secure location to store personal belongings

 

    •    A private venue for wardrobe changes and/or fittings as required

 

    •    Safe working conditions 

 

 

Safety and supervision of our talent

The parent and/or legal guardian of the minor talent sourced through our website and service should be present to supervise the minor at all times. You acknowledge that the parent and/or legal guardian has the right to withdraw from employment at any given time.

Paying our talent

It is the responsibility of the talent buyer to pay the talent in accordance with any pre arrangements made. You acknowledge that payments are made directly by the talent buyer to the talent. You acknowledge that we do not charge commission or booking fees. 

Employment

It is the responsibility of the talent buyer to apply for and obtain the required child employment forms. Should the user be required to negotiate and/or sign a contract or request payment for employment sourced through our website and service, it is the full responsibility of the user or their representative.

 

Code of conduct

As the talent buyer you agree to act in a professional manner when working with talent sourced through our website and service. You acknowledge that we are not held accountable for the talent’s code of conduct in engagements sourced through our website and service.

Working with children check

Talent buyers are requested to show proof of an active Working with Children Check card, prior to the commencement of working with a minor  sourced through our website and service.  We hold the right to inform our members if the talent buyer does not hold an active Working with Children Check card. In the event that the talent buyer does not hold an active Working with Children Check card, the member is required to sign a ‘Non Working with Children Check card’ form on the website, which authorises us to coordinate the job or casting with both parties. This form acknowledges that the parent and/or legal guardian of the minor is aware that the talent buyer does not currently hold an active Working with Children Check card and is still proceeding with the job or casting at their own accord, which was sourced through our website and service.

 

 

Account Access

Users can gain access to the website talent directory by signing in using the Client Login button on the website, and entering their allocated login details consisting of an email and password. Login details are supplied to users at the commencement of using our service. Users may set their own login details up via the Client Login button, or arrange for us to allocate the login details via email. It may take up to forty eight hours to have the login details activated. Login details are allocated to persons deemed appropriate to use our website and service. We hold the right to request further information in relation to the talent buyer, the company and/or project they are casting for. We also hold the right to prohibit a user from accessing our exclusive website and service. Login details should be kept confidential and should not be distributed with non-users.

 

 

Information to supply 

We ask that the talent buyer supplies the following information when submitting a job or casting for listing on our website job board

 

    •    Your name, company name, email, phone and website, as applicable 

    •    Date, time, location, and type of job or casting

    •    Gender, age, size, location and any specific details required 

    •    Usage of footage

    •    Information of talent payment

    •    Working with Children Check card 

    •    A copy of any release forms, contracts or legal documentation if applicable

    •    Application deadline/date

    •    We may also ask the talent buyer to provide us with a company logo for use on the website. 

 

Content publishing 

You acknowledge that as a user of our website and service;

    •    We hold the right to distribute your listing information, text and media supplied by you to us on our website, email and social media platforms, as part of our services to you.
